Area 13 Terms of Use

1. The agreement

These terms are an agreement between you and 13Beacons, LLC, a California limited liability company based in Yucaipa, California. They govern your use of Area 13, our daily puzzle games, whether you play Area 13 for iPhone and iPad or play on the web at area13.app. By playing, you accept them. If you do not, please do not use Area 13.

If you get Area 13 from the App Store, Apple's Standard Licensed Application End User License Agreement governs your license to the app, and these terms add to it. The Area 13 Privacy Notice explains how your information is handled and is part of this agreement.

2. Playing Area 13

Area 13 is free. You may play it for your own personal, non-commercial enjoyment. You may not:

• Copy, republish, sell, or build another product from Area 13's puzzles, word lists, notes, artwork, or code.
• Reverse engineer, scrape, or interfere with the app or area13.app, or try to bypass their security.
• Cheat or manipulate Game Center leaderboards or achievements, for example by editing saved data or changing your device clock.
• Use Area 13 for anything unlawful.

3. Our content and names

Area 13's puzzles, answer lists, reveal notes, design, artwork, and code, and the names Area 13, Night Signal, Flight Path, Crop Circles, and 13Beacons, belong to 13Beacons, LLC and are protected by copyright and trademark law. Sharing your own results, as the Share button does, is welcome. The fonts in Area 13 are used under the SIL Open Font License; see Acknowledgments in the app's settings.

4. Themes are for fun

Area 13's puzzles draw on fiction, folklore, space, and unexplained mysteries. A puzzle or note is entertainment, not a claim that any creature, event, or conspiracy is real.

5. Leaderboards

Game Center is a service of Apple, governed by Apple's terms. We do not control Game Center, its leaderboards, or what other players see, and we may remove or reset Area 13's leaderboards or achievements.

6. Changes to the games

We may add, change, or retire puzzles, games, and features, or stop offering Area 13, at any time. Games shown as coming soon are previews, not promises.

7. No warranties

Area 13 is provided as is and as available. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise that Area 13 will be uninterrupted, error-free, or that your saved progress will never be lost.

8. Limitation of liability

To the fullest extent the law allows, 13Beacons, LLC is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of Area 13. Our total liability for any claim relating to Area 13 is limited to $50. Nothing here limits liability that cannot legally be limited.

9. Governing law

California law governs these terms, without regard to conflict of law rules. Any dispute goes to the state or federal courts in San Bernardino County, California. Before filing anything, email support@13beacons.com and give us 30 days to resolve it. If you live in a country whose law gives you rights these terms cannot remove, those rights still apply.

10. Changes to these terms

We may update these terms. When we do, we will post them here and change the effective date. Continuing to play after that means you accept the update.

11. Everything else

If a provision is unenforceable, the rest stays in force. Not enforcing something once does not waive it later. These terms, the Area 13 Privacy Notice, and, for the app, Apple's Standard EULA are the entire agreement between us about Area 13.
